People smoke marijuana outside the Constitutional Court after cannabis legalized:18 September 2018

South Africa's top court says adults can use marijuana in private. The Constitutional Court on Tuesday upheld a provincial court's ruling in a case involving Gareth Prince, who advocates the decriminalization of the drug.  The Western Cape High Court sensationally ruled that dagga should be legalised for home use in 2017. However, the state appealed this decision and it was put up on the backburner for another year. SA’s Constitutional Court has now made its final decision. The judgement was delivered by none other than Deputy Chief Justice, Raymond Zondo. He’s also the head of the state capture inquiry

Prince says cannabis should be regulated in the same way as alcohol and tobacco. Government authorities have said cannabis is harmful and should be illegal, but the protagonists support that Marijuana and other natural weeds include psychedelic substances can make a user see the ''Gate of Heaven''. People support that marijuana takes a person on a high realm, to experience effects on physical and mental states and then after a couple hours or so the mind and physical reclaims proper functionality.  Top court says an adult can cultivate cannabis in "a private place" as long as it is for personal consumption in private. It says the right to privacy "extends beyond the boundaries of a home." The court says it would be up to a police officer to decide if the amount of marijuana in someone's possession is for dealing or personal consumption.

Dagga in South Africa laws: How it will work for The government now has 24 months to officially write this bill into law. However, private use does have the go-ahead as of Tuesday 18 September. Zondo clarified that it is now up to the ruling ANC to decide what quantities are allowed per person, and it must strictly be based on “personal use”: “The judgement doesn’t specify the amount that can be used by an adult in private use – this must be determined by parliament. 

It must be for the personal use of the person.” The official status for dagga is that it is now “decriminalised”. However, dealing marijuana, selling it on to others or smoking it outside the confines of your own home remains an illegal practice. The official line is that adults are allowed to grow, use and cultivate the substance on their own property. Everything else – including the potential for sin taxes plus the “where and when” of how users can buy dagga – must be outlined by government.
